			<content:encoded><![CDATA[<p>Indian Expeditions Booking Agreement and Terms and Conditions</p>
<p>Please read these terms and conditions carefully. These conditions, along with the other information in our brochure or on our website set out the terms and conditions of the contract between you and Indian Expeditions Limited and show your and our contractual obligations to each other.</p>
<p>Your contract will be governed by Indian law and any disputes will be dealt with in the courts Madras (Chennai.) When mentioned in these conditions the term Holiday refers to accommodation, transport and other holiday services (excluding resort booked excursions) described by us that you book with us. Excursions include, but are not restricted to, any sightseeing trips or other tours attended during the holiday for which additional payments are required.</p>
<p>Booking procedure</p>
<p>a) Bookings must be made on the booking form and sent to us.</p>
<p>b) Bookings will only be accepted from an adult member of the party. We are entitled to assume that the person making the booking has been authorised to do so by the other passengers and therefore accepts this agreement on behalf of all members of the party.</p>
<p>c) Should you have any special requests which do not form part of the contracted services these must be advised to us in writing at the time of booking and will be shown on your confirmation. We will advise hotels of your requests but cannot guarantee that they will be met. Any additional costs involved should be made locally unless otherwise stated. Any special requests made after booking may incur an administration fee.</p>
<p>d) A confirmation invoice will be sent to you on receipt of your deposit. The contract between us comes into force when (but not before) the invoice is issued. Please contact us if you have not received your invoice within ten days of making your booking.</p>
<p>Deposit and final payment</p>
<p>At time of booking a non-refundable deposit of GBP£100, EUR€250, USD$250, CAD$250, AUD$250, CHF250 or NZD$250 per person per tour is due for multi-day tours and USD 50 per person for day tours. Tailor Made tours may require a higher deposit or full payment at the time of booking. If deposit is different from that outlined in this clause, the requirement will be advised at time of booking and detailed on the invoice. If combinations of Tours, Independent Tours and Tailor Made tours are booked, the most restrictive requirements will apply to the whole booking. Indian Expeditions allows you to pay the rest of the cost of tour after the tour is delivered. This is for our guide services only and does not include transport bookings, hotels, etc. which must be paid for before the start of tour or at the time of your final booking.  As per Our Lifetime Deposit policy, any of our passengers forced to delay a departure retain their initial deposit for use at a later date at no extra charge. Lifetime Deposits: Should the Client cancel their booking, the deposit value will be held as a ‘Lifetime Deposit’ with the Company, subject to the full extent of these terms and conditions. This Lifetime Deposit has no expiry and may be used as a deposit on one future Company tour. Any specific permit costs above the deposit amount are subject to different terms and conditions as applied by the Company. The Lifetime Deposit has no cash value. Only one Lifetime Deposit may be applied per tour. All Lifetime Deposits must be applied to a new tour that is of equal or greater value than the cancelled tour. A booking may not be cancelled, and have the Lifetime Deposit applied to the same or similar dates of travel or a tour at a price lower than the cancelled tour. The Lifetime Deposit may be transferred or gifted to another Client.</p>
<p>Insurance</p>
<p>We highly recommend you obtain a travel insurance. If you do not make appropriate insurance arrangements Indian Expeditions Ltd. will not be liable for any losses or expenses which you may incur for claims which might normally have been covered by insurance in respect of circumstances for which we are not responsible.</p>
<p>Surcharges</p>
<p>We reserve the right to alter the price of any holiday in our brochure or on our website. You will be advised of the current price of the holiday at the time of booking.</p>
<p>Changes in exchange rates means that the price of your holiday may change after you have booked. However, there will be no change within 30 days of your departure.</p>
<p>We will absorb, and you will not be charged for, any increase equivalent to 2% of your holiday price (excluding any amendment charges), there may be a charge for any further increases up to 10% of the value of your holiday. Should the price of your holiday go down by more than 2% due to changes in exchange rates then you will be refunded the appropriate amount. However, please note that some apparent changes may not impact on the price of your holiday due to contractual and other protection in place.</p>
<p>Alteration or cancellation of booking by you.</p>
<p>a) If you request changes to your holiday after we have sent an invoice we will do our best to accommodate you but that may not always be possible. Requests for alterations must be made in writing by the person who booked the holiday. There will be an administration charge of  USD 10 per person plus any additional costs which we may incur in making the changes. An alteration is deemed to be a correction or enhancement of your existing holiday, major changes (including for example changing dates, substituting destinations or in any other way significantly altering the holiday) will be deemed a cancellation and charges will apply</p>
<p>b) If you alter any arrangements during your holiday we will not be liable for any expenses you incur, nor be obliged to refund any payment for unused services or accommodation.</p>
<p>c) Should any member of your party wish to cancel their holiday we must be informed in writing by the person who made the booking. We will charge cancellations fees according to the table below (you may be able to claim some of this through your insurance). If one member of the party cancels the remainder will be liable for any extra charges incurred (e.g. a single room surcharge coming into effect). The person who cancelled will still be liable for cancellation charges as shown below.</p>
<p>Cancellation fee:</p>
<p>If you cancel 60 days before start of tour: Full Refund</p>
<p>If you cancel 59 to 30 days before the start of the tour: Amount paid less any non-recoverable upfront costs incurred by Indian Expeditions on your behalf. These upfront costs represent out of pocket expenses of Indian Expeditions for tickets, transportation deposits and other tour expenses. Please send a message to Indian Expeditions to find out what, if any, these costs are.</p>
<p>If you cancel 29 days or less before start of tour: Company holds deposit [amount paid less upfront costs] as Lifetime Deposit. These upfront costs represent out of pocket expenses of Indian Expeditions for tickets, transportation deposits and other tour expenses. Please send a message to Indian Expeditions to find out what, if any, these costs are.</p>
<p>d) If you are unable to take your holiday you may transfer it to someone else subject to the approval of all interested suppliers. If you transfer the booking before paying the balance due you will still be liable for it if the transferee fails to pay.</p>
<p>Alteration or cancellation of booking by us:</p>
<p>a) Although we make every reasonable effort to avoid doing so, occasionally we may have to make significant alterations to your holiday arrangements and we reserve the right to do so at any time. You will be informed of such changes as soon as reasonably possible and given the choice of accepting the changed arrangements or receiving a full refund.</p>
<p>Significant alterations could include a change of resort area or accommodation type.</p>
<p>b) If an alteration is deemed necessary by us due to circumstances beyond our control no compensation is payable. If we make a significant alteration for any other reason, or have to cancel your holiday for any reason (not your fault or not due to circumstances beyond our control) compensation will be offered as below:</p>

<p>b) In exceptional cases we may have to cancel your holiday. In such a case you will be offered an alternative holiday or a full refund.</p>
<p>c) If we are forced to cancel your holiday due to circumstances beyond our control no compensation is payable.</p>
<p>In this contract Circumstances beyond our control can included for example, terrorist activity and its consequences, war, industrial dispute, riot, natural or nuclear disaster, fire, weather conditions etc.</p>
<p>Travel delays</p>
<p>Travel may be disrupted due to bad weather, technical problems or other circumstances, in such cases we are not obliged to refund any payment for unused accommodation or services.</p>
<p>Brochure accuracy</p>
<p>At times facilities which are advertised on our website or in our brochure may be withdrawn for such reasons as maintenance, adverse weather or lack of demand. Outside of the peak season it is common for some facilities and services to be less widely available in resort destinations. We have no control over availability and pricing of local activities such as water sports. There may be charges for some services and facilities at hotels (for example safe deposit boxes)</p>
<p>Our liability</p>
<p>a) We accept responsibility for the proper performance of the services which we have contracted to supply. If they are not provided in a reasonable standard according to local minimum standards due to the fault of our employees, agents or suppliers and this affects the enjoyment of your holiday we will pay appropriate compensation. We will not be liable if the failure of performance of the contract was due to you, a third party not connected with the provision of your holiday, unforeseen and unavoidable circumstances or circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised. In circumstances where we are not at fault we will offer such prompt assistance as is deemed reasonable in the circumstances.</p>
<p>b) Our liability, except in cases involving injury, illness or death, shall be limited to twice the cost of your holiday. Our liability shall also be limited by any relevant convention, for example, the Paris Convention in respect to the provision of accommodation and any other relevant Conventions which limit the amount which you can claim for death and injury. We are to be regarded as having all benefit of any limitation of compensation contained in this or any conventions.</p>
<p>c) Compliance with passport, visa and other immigration requirements are your responsibility, you should confirm these with the relevant embassies. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.</p>
<p>d) We accept responsibility (as limited by the previous sections of this clause) for the holiday sold to you and detailed on your confirmation. We shall not be responsible for any tours or excursions which you may choose to book and pay for whilst on holiday which are not part of our agreement. For such tours and excursions your contract will be with the local operator and not with us. We are not responsible for the provision of the tour or excursion or for anything that happens during said tour or excursion provided by the local operator.</p>
<p>Your responsibility</p>
<p>We want all of our customers to have an enjoyable, carefree holiday so please be aware that your actions may affect others. If we, or another person in authority, believe that your actions could upset, annoy or disturb other customers, our staff or our suppliers, or put them in any risk of danger, or damage property then we reserve the right to terminate your holiday. You and your party will be prevented from using your accommodation, transport and any other facilities which constitute part of your booking and we will not be liable for any compensation, refund or other costs which you may have to pay.</p>
<p>You are also responsible for your own safety and the condition of the property which you occupy. We are not responsible for any accidents which occur in or around swimming pools due to inappropriate or irresponsible behaviour. We expect that you will enjoy your holiday with us and appreciate that that enjoyment may involve the consumption of alcohol. You are, however expected to drink responsibly and we will have no liability to you for any injury, loss or damage you suffer as a result of your judgement being impaired wholly or partly by alcohol. We will hold you and the members of your party jointly and individually responsible for any damage to the accommodation, together with any legal costs we incur in pursuing a claim. It is your duty to report any breakages, defects or damage to an appropriate person immediately.</p>
<p>Complaints</p>
<p>We understand that in spite of our care problems may arise. If you have any complaint about any aspect of your holiday you must report it at the earliest opportunity to our local representative, failure to do so will not enable us to attempt to rectify the problem at the time and may affect your rights under this contract. Should you feel that matters have not been satisfactorily resolved for you locally please write to Indian Expeditions Ltd. within 28 days of end of tour. Please keep your correspondence concise and to the point to assist us to quickly identify your needs and make a speedy response.</p>
<p>This contract is made on the terms of this agreement which is governed by Indian Law and in the jurisdiction of the Madras courts</p>
<p>Date of issue June 2012</p>
<p>All information correct at date of issue and supersedes any previous Terms and Conditions.</p>

At its height the Chola empire spanned almost 3,600,000 km² (1,389,968 sq mi) straddling the Bay of Bengal. With the decline of the three ancient dynasties during the 14th century, the Tamil country became part of the Vijayanagara Empire. Under this empire the Telugu speaking Nayak governors ruled the Tamil land. The brief appearance of the Marathas gave way to the European trading companies, who began to appear during the 17th century and eventually assumed greater sway over the indigenous rulers of the land.</p>
<p>Tamil Nadu is the host of many of India&#8217;s greatest temples and we will visit some of the most ancient, monumental and most important temples of South India.</p>

It rose to be a prominent city between the 7th and 9th centuries AD, when it served as a capital of the Medieval Cholas. <p>Now, many centuries after the first dhow from Arabia sought out the spice-rich coast of known as the Malabar, Indian Expeditions invites you to join us on a travel program through the magnificent Western Ghats.</p>
<p><strong>The Western Ghats</strong> are one of the world&#8217;s ten &#8220;Hottest biodiversity hotspots&#8221; with over 5000 species of flowering plants, 139 mammal species, 508 bird species and 179 amphibian species. At least 325 globally threatened species occur in the Western Ghats, along with several tribal groups whose traditional lifestyle is fast being eroded. The Nilgiri Bio-sphere is home to the largest population of Asian Elephants and forms an important Project Elephant and Project Tiger reserve. The largest population of India&#8217;s Tigers outside the Sundarbans is in the unbroken forests bordering Karnataka, Tamil Nadu and Kerala. There are at least 16 species of birds endemic to the western Ghats including the endangered Rufous-breasted Laughingthrush, the vulnerable Nilgiri Wood-pigeon, White-bellied Shortwing and Broad-tailed Grassbird.</p>

We will explore tranquil rural villages with astounding temples and gigantic gopuras (towers) soaring above the palm forests and paddy fields. We will cruise on a house boat in enchanting Kerala and safari into tiger reserves to spot the elusive tiger and other mega fauna. Further, on the South India Tour, we will visit the ruins of the Vijayanagara kingdom in Hampi and explore Mysore, the city of palaces. The British built their first fort here and leading to the Brithish Empire in India. The Madras Presidency was one of British India&#8217;s most important divisions. <h4><strong>Day 3: Kanchipuram and Mahabalipuram (Mamallapuram)</strong></h4>

<p>We depart Chennai early and a 1.5 drive takes us to the temple town of Kanchipuram, one of India’s seven sacred cities. The ancient capital of the Pallava and Chola dynasties, Kanchipuram still boasts of about 200 ancient temples. In addition to being an important pilgrimage center, Kanchipuram is today a bustling center of commerce, known best for its handwoven silk fabrics, especially sarees.</p>
<p>We then proceed to Mahabalipuram and check into a beach resort. We will spend the evening part of the next day exploring the ancient 5th century port, Mahabalipuram and be amazed by ancient, exquisite rock sculptures.</p>

<h4><strong>Day 4: Agrarian Village and Pondicherry</strong></h4>

Here, we witness traditional farming techniques and communal lifestyles. We get to interact with traditional farmers, get a glimpse of India&#8217;s cast system, and look into chores, rituals and festivals associated with everyday life in India. We then follow the scenic East Coast Road and explore India&#8217;s French connection, Pondicherry, where we will visit the Arabindo Ashram and Auroville, a spiritual commune. We then go on to a handicraft manufacturing unit, and other places of interest in peaceful Pondy and you could even learn some French here if you want!</p>

We will visit the &#8220;Big Temple,&#8221; the magnificent Brahadeswhara Temple built in the 11th century, regarded as one of India&#8217;s most magnificient ancient structures. We will go on an orientation drive and visit a Vedic and Sanskrit school and commune, and interact with professors and students. We will view age old methods of bronze casting and attend a classical dance program, where you will have a chance to interact with traditional dancers and musicians</p>

We will explore the bi lanes of this ancient city and witness vibrant and mysterious rituals in the awe-inspiring Madurai Meenakshi Temple.  Madurai was known to have had links with Greece as far back as the 4th Century BC, and became became a major center for writers, builders and academics. Today, its main attraction is the labyrinthine complex of temples within the Sri Meenakshi Temple, spread over six hectares. The temple contains friezes, stone and brass images, as well as one of the best exhibits of Hindu deities in its 1000-pillared hall. Outside the temple are the Musical Pillars which when tapped, produce the entire scale of ‘swaras’ or musical notes. Your sightseeing tour in Madurai will include visits to Tkulum (Mariamman) a tank with an island temple in the middle, the museums and the bustling bylanes of the Madurai market.</p>

<p>We bid farewell to the Jungles and to all the friends that we would have made during our trip there and proceed to Kochi, the spice capital of ancient India. We will check into a home stay and experience the warmth of an Indian family hospitality. We will explore ancient churches and synagogues, take walks around the beach and spot dolphins and watch fisherman catch fish using ancient style huge Chinese fishing nets.</p>

<h4><strong>Day 15 and 16: Mysore</strong></h4>

The magnificent Maharaja’s Palace that marks the city’s skyline is adorned on the inside with an abundance of stained glass, mirrors and gilt. The Chamrajendra Zoological Gardens in Mysore is one of the best in India, and the Art Gallery has what is probably the finest collection of paintings and musical instruments. Another must-see, is the Durga (Kali) temple atop the Chamundi Hill, only 10 kms south of Mysore. Mysore is also the incense manufacturing capital of the country. We also visit  Srirangapatnam, the place from where Haider Ali and Tipu Sultan ruled much of southern India during the 18th Century. Built on a long island in the Cauvery River, the crumbling fort of Srirangapatnam stands as testimony to their historic resistance to the British.</p>

<h4><strong>Day 17 and 18: Hospet, Badami</strong></h4>
<p>Our next stop on this wonderful South India Tour is at Badami. Set in a beautiful countryside among red sandstone hills, rock hewn tanks and farmlands, Badami was once the capital of the mighty Chalukyan Empire, that ruled vast parts of central and south India from the 4th-8th Century. At Badami, you will see some of the finest examples of Dravidian cave temples.</p>
<p>From Badami, you will take a full day excursion to Aihole and Pattadakal. Aihole is where you will witness the evolution of Hindu temple architecture from the early shrines of the Lad Khan Temple to more complex structures like that of the Meguti Temple. In the centre of the village is the famous Durgigudi temple, known for its semicircular apse and the outstanding carvings that crowd the colonnaded passageway. Pattadakal, another developing ground for Hindu temple architecture, was the second capital of the Badami Chalukyans, used specially for royal coronations.</p>

<h4><strong>Day 1 &amp; 2: Chennai</strong></h4>

We will take a walk through Chennai&#8217;s busy gold and saree market and learn how to bargain the Indian way. We visit some of Chennai&#8217;s most prominent temples, some of which date back to many centuries ago. You will be mesmerized with the Chennai Egmore museums exquisite collection of bronze sculptures from as early on as the 5th century. We will attend an Indian Classical music concert and explore the trail of the Apostle Doubting Thomas and visit the St Thomas Basilica, where the apostle is said to have been originally buried.</p>

<p>We will explore the ancient 5th century port, Mahabalipuram and be amazed by ancient, exquisite rock sculptures. Here we will relax in an exquisite beach resort, and dine on some fine sea food.</p>

<h4><strong>Day 4: Agrarian Village and Pondicherry</strong></h4>
<p>We will visit an agrarian village and understand the true beat of India. We will witness traditional farming techniques and communal lifestyles. We will interact with traditional farmers, get a glimpse of India&#8217;s cast system, and look into chores, rituals and festivals associated with everyday life in India. We then follow the scenic East Coast Road and explore India&#8217;s French connection, Pondicherry, where we will visit the Arabindo Ashram and Auroville, a spiritual commune. We then go on to a handicraft manufacturing unit, and you could learn some French here if you want!</p>

<h4><strong>Day 5 and 6: Tanjavur</strong></h4>

We will visit the &#8220;Big Temple,&#8221; the magnificent Brahadeswhara Temple built in the 11th century, regarded as one of India&#8217;s most magnificient ancient structures. We will go on an orientation drive and visit a Vedic and Sanskrit school and commune, and interact with professors and students. We will view age old methods of bronze casting and attend a classical dance program, where you will have a chance to interact with traditional dancers and musicians</p>

<h4><strong>Day 9 and 10: Periyar National Park</strong></h4>

We will spend two leisurely and relaxed days going on Safari to spot the big cats and other mega fauna and we will visit a tea and spice plantation, taking slow walks amongst breathtaking scenario, or you could go on a more rigorous trek. Here, we also interact with tribals and ex poachers and understand the impact of sustainable tourism on indigenous people and sensitive ecology.</p>

<h4><strong>Day 11 and 12: House Boat, Kumarakom</strong></h4>
<p>We bid farewell to the Jungles and to all the friends that we would have made during our trip there and proceed to Kumarakom, a stunningly beautiful town in Kerala. Hop on a house boat on which we spend a night cruising the spectacular back waters of Kerala at a leisurely pace. We then can visit a local village or spice plantation.</p>

<h4><strong>Day 13 and 14: Alleppey</strong></h4>
